2 sectoral credit policy criteria

  • Holds complete legal documents for the land used for business purposes, as well as the related environmental and social permit documents, such as the Principle Permit, Location Permit, Plantation Business Permit (IUP), and the Environmental Impact Assessment (AMDAL) or Environmental Management and Monitoring Effort (UKL-UPL) permit, in accordance with the applicable laws and regulations.
  • Complies with the laws and regulations, government regulations, and government policies applicable to the (prospective) debtor, particularly those relating to human rights, labor, the environment, and applicable social responsibility.

Coal Mining

2 sectoral credit policy criteria

  • Holds complete legal documents on the land used for business, as well as environmental and social permit documents in accordance with the applicable laws and regulations.
  • Complies with the laws and regulations, government regulations, and government policies that apply to the (prospective) debtor, especially those related to occupational safety and health, labor, the environment, and applicable social responsibility.

Timber & Forest Products Industry

3 sectoral credit policy criteria

  • Holds complete documentation for industries that utilize and manage timber sources*, both upstream and downstream, including: (a) the Timber Legality Verification System (SVLK)** for all timber products circulated and traded in Indonesia; and/or (b) the V-Legal Document for the export of forestry industry products.
  • Holds complete legality documents for timber sources and business activities, as well as environmental and social permit documents in accordance with the applicable laws and regulations.
  • Complies with the laws and regulations, government regulations, and government policies that apply to the (prospective) debtor, especially those related to occupational safety and health, labor, the environment, and applicable social responsibility.

Notes:

* Timber sourced from recycled materials is exempt from this requirement.

** The Timber Legality Certificate (SLK) must have a valid period of validity.

Toll Road Development

2 sectoral credit policy criteria

  • Holds complete documentation relating to readiness criteria, business permits, and environmental and social permits in accordance with the applicable laws and regulations.
  • Complies with the laws and regulations, government regulations, and government policies that apply to the (prospective) debtor, especially those related to the minimum service standards for toll roads and toll road development, occupational safety and health, labor, the environment, and applicable social responsibility.

Cement & Basic Iron and Steel Industry

2 sectoral credit policy criteria

  • Holds the complete documentation required for its industry, in accordance with the applicable laws and regulations.
  • Complies with the laws and regulations, government regulations, and government policies that apply to the (prospective) debtor, especially those related to occupational safety and health, labor, the environment, and applicable social responsibility.

Oil & Gas Industry

4 sectoral credit policy criteria

  • Holds the documents required by the applicable regulations (such as laws/government regulations) for the oil and gas industry sector, in accordance with the type/scheme of financing and its business activities.
  • Complies with the applicable legal provisions/regulations (such as laws/government regulations) in accordance with the type/scheme of financing and its business activities, particularly those relating to environmental protection, Occupational Health and Safety (OHS/K3), labor, and corporate social responsibility.
  • For (prospective) debtors required by the Ministry of Environment/Environmental Control Agency (KLH/BPLH) to undergo the Corporate Performance Rating Assessment Program in Environmental Management (PROPER), the results of that PROPER assessment must be disclosed. If the PROPER assessment results do not meet environmental requirements, follow-up must be carried out in accordance with the applicable provisions.
  • For (prospective) debtors involved in the exploration and production of unconventional oil and gas (tar sands, shale oil & gas, ultra-deep-water (UDP) oil & gas, arctic oil & gas) as well as liquefied natural gas (LNG), compliance with the applicable ESDM Ministerial Regulations and other relevant laws and regulations is required.

Electricity

3 sectoral credit policy criteria

  • Holds the documents required by the applicable regulations (such as laws/government regulations) for the electricity sector, in accordance with the type/scheme of financing and its business activities.
  • Complies with the applicable legal provisions/regulations (such as laws/government regulations) in accordance with the type/scheme of financing and its business activities, particularly those relating to environmental protection, occupational health and safety (OHS/K3), labor, and corporate social responsibility.
  • For (prospective) debtors required by the Ministry of Environment/Environmental Control Agency (KLH/BPLH) to undergo the Corporate Performance Rating Assessment Program in Environmental Management (PROPER), the results of that PROPER assessment must be disclosed. If the PROPER assessment results do not meet environmental requirements, follow-up must be carried out in accordance with the applicable provisions.

Hotel

4 sectoral credit policy criteria

  • Holds an Environmental Impact Assessment (AMDAL) document or an Environmental Management and Monitoring Effort (UKL-UPL) document that has been approved by the competent authority.
  • Maintains provisions and/or certifications relating to Occupational Health and Safety (OHS/K3) in accordance with the applicable regulations.
  • For publicly listed companies, a Sustainability Report is required in accordance with OJK (Financial Services Authority) regulations.
  • There is no adverse information regarding social and environmental breaches that would materially affect business continuity.

Chemicals and Plastics

6 sectoral credit policy criteria

  • Takes into account the PROPER environmental rating for businesses required to obtain it by the Ministry of Environment (KLH).
  • Holds an Environmental Impact Assessment (AMDAL) document or an Environmental Management and Monitoring Effort (UKL-UPL) document that has been approved by the competent authority.
  • Holds environmental management and waste management certifications that comply with the applicable regulations and are acceptable to the Bank.
  • Maintains provisions and/or certifications relating to Occupational Health and Safety (OHS/K3) in accordance with the applicable regulations.
  • For publicly listed companies, a Sustainability Report is required in accordance with OJK (Financial Services Authority) regulations.
  • There is no adverse information regarding social and environmental breaches that would materially affect business continuity.

Hospitals

5 sectoral credit policy criteria

  • Maintains provisions and/or certifications relating to Occupational Health and Safety (OHS/K3) in accordance with the applicable regulations.
  • Holds a Wastewater Management Permit / a Hazardous Waste (B3) Management Permit (medical/pharmaceutical waste).
  • Holds an Environmental Impact Assessment (AMDAL) document or an Environmental Management and Monitoring Effort (UKL-UPL) document that has been approved by the competent authority.
  • For publicly listed companies, a Sustainability Report is required in accordance with OJK (Financial Services Authority) regulations.
  • There is no adverse information regarding social and environmental breaches that would materially affect business continuity.

Pharmaceuticals

6 sectoral credit policy criteria

  • Maintains provisions and/or certifications relating to Occupational Health and Safety (OHS/K3) in accordance with the applicable regulations.
  • Holds a Wastewater Management Permit and/or a Hazardous Waste (B3) Management Permit (medical/pharmaceutical waste).
  • Holds an Environmental Impact Assessment (AMDAL) document or an Environmental Management and Monitoring Effort (UKL-UPL) document approved by the competent authority (except for distributors).
  • Meets the standards of the National Agency of Drug and Food Control (BPOM) to ensure the quality of the pharmaceutical products manufactured.
  • For publicly listed companies, a Sustainability Report is required in accordance with OJK (Financial Services Authority) regulations.
  • There is no adverse information regarding social and environmental breaches that would materially affect business continuity.

Shipping

4 sectoral credit policy criteria

  • Holds an Environmental Impact Assessment (AMDAL) document or an Environmental Management and Monitoring Effort (UKL-UPL) document approved by the competent authority, together with vessel seaworthiness documentation.
  • Maintains provisions and/or certifications relating to Occupational Health and Safety (OHS/K3) in accordance with the applicable regulations.
  • For publicly listed companies, a Sustainability Report is required in accordance with OJK (Financial Services Authority) regulations.
  • There is no adverse information regarding social and environmental breaches that would materially affect business continuity.

Rental, Bus, and Land Logistics

2 sectoral credit policy criteria

  • Maintains provisions and/or certifications relating to Occupational Health and Safety (OHS/K3) in accordance with the applicable regulations.
  • Transportation modes that meet the applicable exhaust-emission standards and fuel-efficiency requirements.

Food and Beverage

4 sectoral credit policy criteria

  • Holds an Environmental Impact Assessment (AMDAL) document or an Environmental Management and Monitoring Effort (UKL-UPL) document — including a Water Utilization Permit (SIPPA) for the bottled drinking water (AMDK) industry — approved by the competent authority.
  • Maintains provisions and/or certifications relating to Occupational Health and Safety (OHS/K3) in accordance with the applicable regulations.
  • For publicly listed companies, a Sustainability Report is required in accordance with OJK (Financial Services Authority) regulations.
  • There is no adverse information regarding social and environmental breaches that would materially affect business continuity.

Non-Oil & Gas Mining

7 sectoral credit policy criteria

  • Holds an Environmental Impact Assessment (AMDAL) document or an Environmental Management and Monitoring Effort (UKL-UPL) document that has been approved by the competent authority.
  • Takes into account the PROPER environmental rating for businesses required to obtain it by the Ministry of Environment (KLH).
  • The company applies Good Mining Practice in accordance with the applicable laws and regulations — for example, submitting a Work Plan and Budget (RKAB) approved by the Ministry of Energy and Mineral Resources (ESDM) and placing a Reclamation and Post-Mining Guarantee in accordance with the requirements set by the competent authorities.
  • Maintains provisions and/or certifications relating to Occupational Health and Safety (OHS/K3) in accordance with the applicable regulations.
  • Holds Waste Management Permits (including tailings, hazardous waste/B3, and others) in accordance with the applicable regulations.
  • For publicly listed companies, a Sustainability Report is required in accordance with OJK (Financial Services Authority) regulations.
  • There is no adverse information regarding social and environmental breaches that would materially affect business continuity.

Telecommunications

3 sectoral credit policy criteria

  • Maintains provisions and/or certifications relating to Occupational Health and Safety (OHS/K3) in accordance with the applicable regulations.
  • For publicly listed companies, a Sustainability Report is required in accordance with OJK (Financial Services Authority) regulations.
  • There is no adverse information regarding social and environmental breaches that would materially affect business continuity.

Property

6 sectoral credit policy criteria

  • Land legality is in order, with land status not subject to any legal proceedings or dispute.
  • Conformity of land use and of the Building Coverage Ratio (KDB), Floor Area Ratio (KLB), and Building Setback Line (GSB) with the project specifications.
  • Permits obtained are appropriate to the development stage and project type [including, among others: Land Acquisition Designation Permit (SP3L), Principle Permit, Environmental Permit (AMDAL/UKL-UPL, Traffic Impact Analysis/ANDAL LALIN), Building Approval (PBG), and Certificate of Worthy Function (SLF)].
  • Track record of the developer or developer group.
  • For publicly listed companies, a Sustainability Report is required in accordance with OJK (Financial Services Authority) regulations.
  • There is no adverse information regarding social and environmental breaches that would materially affect business continuity.

Construction

3 sectoral credit policy criteria

  • Maintains provisions and/or certifications relating to Occupational Health and Safety (OHS/K3) in accordance with the applicable regulations.
  • For publicly listed companies, a Sustainability Report is required in accordance with OJK (Financial Services Authority) regulations.
  • There is no adverse information regarding social and environmental breaches that would materially affect business continuity.

Automotive (Dealer – Main Dealer – Manufacturer)

5 sectoral credit policy criteria

  • Holds an Environmental Impact Assessment (AMDAL) document or an Environmental Management and Monitoring Effort (UKL-UPL) document that has been approved by the competent authority.
  • Maintains provisions and/or certifications relating to Occupational Health and Safety (OHS/K3) in accordance with the applicable regulations.
  • Has activities/products that support the use of renewable energy and that meet the applicable exhaust-emission standards and fuel-efficiency requirements.
  • For publicly listed companies, a Sustainability Report is required in accordance with OJK (Financial Services Authority) regulations.
  • There is no adverse information regarding social and environmental breaches that would materially affect business continuity.
