Terms of Implementation of the Gebyar Badan Usaha BCA Program (Period 1 April 2024 – 30 September 2024)

A. General

PT Bank Central Asia Tbk (“BCA”) may invite its customers, who are entities with a current account in rupiah currency at BCA (“Customer”), to participate in the Gebyar Badan Usaha BCA Program (“Sweepstakes Program”), which will be held by BCA from April 1, 2024, to September 30, 2024.
The implementation of the Sweepstakes Program will be carried out with these Terms of Implementation of the Gebyar Badan Usaha BCA Sweepstakes Program (“Terms”) and other provisions determined by BCA, which will be notified by BCA to the Customer in any form and through any means in accordance with applicable law.
BCA reserves the right to terminate the Customer’s participation in the Sweepstakes Program if:

the Customer is no longer a BCA Customer for any reason during the Sweepstakes Program period;
the Customer is indicated or proven to have committed acts of fraud and/or any cheating in or during the Sweepstakes Program;
the Customer violates and/or does not fulfil these Terms, either in part or full;
the Customer is enlisted in the National Blacklist issued by Bank Indonesia;
the Customer is on the blacklist merchant registry issued by the Indonesian Credit Card Association;
the collectability of the Customer’s credit facilities with BCA is substandard (collectability 2-5);
the Customer’s credit facility at BCA is in the process of restructuring;
the Customer is petitioned or declared in a state of bankruptcy, Postponement of Debt Payment Obligations (PKPU), or liquidated in accordance with applicable law;
the Customer engages in a line of business that is prohibited by applicable law;
the Customer is suspected or proven to be involved in a criminal offense or other actions that violate the law;
the Customer is suspected or proven to have a known and/or reasonably suspected source of funds originating from the proceeds of a criminal offense; and/or
there are laws that prevent the Customer from receiving the Prize or participating in the Sweepstakes Program.

B. Points Collection and Drawing

During the period from April 1, 2024, to September 30, 2024 (“Sweepstakes Program Period”), customers participating in the Sweepstakes Program (“Participant”) may collect sweepstakes points.
The points earned by the Participant will be calculated every month during the Points Collection Period with the following conditions:

If the average balance in the Rupiah giro account (“Giro Account”) of each Participant at BCA (excluding joint account, Customer Fund Account (RDN), and Lender’s Account (RDL)) in a month reaches Rp5,000,000 (five million rupiah), the Customer is entitled to 1 sweepstakes point (multiples apply) for the funds deposited in the Participant’s Giro Account in that month.

The Customer shall be entitled to get extra points if the Participant performs the following activities:

No.	Activity	Number of additional points earned in that month*
1.	Perform payrolltransactions through myBCA Bisnis/KlikBCA Bisnis/KlikBCA Bisnis-Integrated Solution	Based on the total points earned by the Participant for the funds deposited in the Participant’s Giro Account in the month of the payroll transaction.
2.	Have an active EDC machine/active static QRIS/valid Fleet Card registered with KlikBCA Bisnis of the Participant	Based on the total points earned by the Participant for the funds deposited in their respective Giro Account every month (since the time the Participant is first recorded as having an active EDC machine/active static QRIS/valid Fleet Card registered with KlikBCA Bisnis of the Participant until the Participant is no longer recorded as having an active EDC machine/active static QRIS/valid Fleet Card registered with KlikBCA Bisnis of the Participant).
3.	Fluent collectability for all Participant’s productive credit facilities at BCA (excluding Visa Corporate)	2x of the total points earned by the Participant for the funds deposited in their respective Giro Account each month as long as the collectability of all of the Participant’s productive credit facilities at BCA remains fluent.

Once the Sweepstakes Program Period ends, BCA will convert the sweepstakes points earned by the Participant into sweepstakes coupons. Each sweepstakes point is equal to one sweepstakes coupon.
BCA will notify the Participant about the sweepstakes coupon through the email address registered with BCA.
The Participant may request information regarding the total points and sweepstakes coupons that the Participant has earned to BCA through BCA branch offices or by contacting Halo BCA services.
BCA will conduct a draw in November 2024 to determine the winner of the Prize offered in the Sweepstakes Program (“Prize”).
The Prizes of the Sweepstakes Program are as follows:
1. 3 (three) units of Toyota Kijang Innova Zenix Hybrid EV 2.0L G HV CVT car*
2. 10 (ten) units of Yamaha Gear 125 S motorcycle*
3. 25 (twenty-five) units of Antam Precious Metals, each weighing 10 gram
4. 50 (fifty) units of Antam Precious Metals, each weighing 5 gram
5. 100 (one hundred) units of Antam Precious Metals, each weighing 2 gram
  *Note: if the listed vehicle is unavailable, BCA has the right to substitute it with another type of the same price.
The Participant is only entitled to 1 (one) Prize.
The decision of the Prize winner is final and inviolable.

C. Awarding of Prizes

The winner of the Prize (“Prize Winning Participant”) must collect the Prize within 30 calendar days from the date of the draw.
The Prize Winning Participant cannot transfer their right to receive the Prize to any other party, including other Participants.
BCA has the right to ask for a power of attorney/appointment from the Prize Winning Participant in favor of the party appointed to represent the Prize Winning Participant in collecting the Prize. BCA may refuse to hand over the Prize to a party that cannot be verified by BCA as a Prize Winning Participant or its proxy following the applicable provisions at BCA.
All tax obligations and/or other state revenues arising from the acquisition of the Prize by the Prize Winning Participant in the Sweepstakes Program will be fully borne by the Prize Winning Participant.
If the Prize Winning Participant does not collect the Prize within the specified period in point C.1 above, the Prize will be referred to as Unclaimed Prize (HTDP), and BCA has the right to hand it over to the authorized agency in accordance with the applicable law. The Prize Winning Participant cannot submit any claim or demand to BCA for the Prize that is not claimed until such period expires.

D. Miscellaneous

BCA reserves the right to modify, supplement, or substitute these Terms. Any such changes will be notified to the Participant in any form and through any means in compliance with the applicable law.
The implementation of the Sweepstakes Program and these Terms are subject to the provisions of the applicable law in the Republic of Indonesia.
If a dispute arises in connection with the implementation of the Sweepstakes Program and/or the interpretation and implementation of these Terms, the parties will resolve the dispute by deliberation to reach a consensus. Any dispute or difference of opinion that cannot be resolved amicably by BCA and the Customer will be resolved through banking facilitation at Bank Indonesia or the Financial Services Authority or mediation conducted through an alternative Dispute Resolution Institution listed in the List of Alternative Dispute Resolution Institutions established by the Financial Services Authority. If the dispute cannot be resolved through deliberation, banking facilitation, and/or mediation as referred to above, the Customer agrees to resolve the dispute through the Central Jakarta District Court, without prejudice to BCA’s right to file a lawsuit or claim through another District Court within the territory of the Republic of Indonesia.

The Terms and Conditions of the Gebyar Badan Usaha BCA Sweepstakes Program have been adjusted to the provisions of the laws and regulations including the provisions of the Financial Services Authority Regulation
