The Term and Condition of BCA Credit Card

Article 1

  1. BCA Card, BCA Mastercard, BCA Visa Card, BCA JCB Card, BCA UnionPay Card, and other credit cards (each referred to as "Card") issued by PT Bank Central Asia Tbk ("BCA") are the property of BCA.
  2. BCA may cooperate with a BCA business partner ("Cobrand Partner") to issue a Card bearing BCA’s logo and the BCA business partner’s logo or otherwise a logo determined by the BCA business partner ("Cobrand Card").

Article 2

  1. BCA will deliver the Card, whether a new Card or a renewal Card, directly to the party whose name is printed on the Card ("Cardholder") at the address on record with BCA. If at the time of the Card delivery, the Cardholder is unavailable to directly receive the Card from BCA, the Cardholder hereby authorizes BCA to deliver the Card, whether a new Card or a renewal Card, to another party at the Cardholder's address as per BCA’s data, provided that BCA records the Card delivery date and the card recipient’s identity.
  1. The Card is non-transferable and must be signed by the Cardholder whose name is printed on the Card and must not be used by another person that may succeed the Cardholder in position. During the validity of the Card, the Cardholder is the only person entitled to use the Card to make payment transactions to a merchant using the Card ("Merchant"), make cash withdrawals through ATMs, or withdraw cash at BCA branch offices/other banks that accept cash withdrawal transactions using the Card. BCA is not responsible for any refusal by the Merchant to accept payments using the Card.
  2. Cards that come with a contactless feature can be used to complete transactions by holding the Card (without dipping/swiping the Card in) over an Electronic Data Capture (EDC) machine or another contactless-enabled payment terminal. Contactless transactions can be carried out without a PIN by taking into account the limits and regulations determined by the Card networks or those applicable in each country where the Cardholder makes transactions as well as the transaction limit and the number of allowable contactless transactions determined by BCA.
  3. BCA shall not be responsible for the refusal of payment using the Card by the Merchant.
  4. BCA reserves the right to offer products/services via personal communication facilities. If the Cardholder does not agree, the Cardholder can contact Halo BCA.

Article 3

  1. A Cobrand Card Holder that has not become a member of the Cobrand Partner when applying for a Cobrand Card will be registered as a member of the Cobrand Partner. This provision only applies to the main Cardholder. A supplementary Cardholder that wishes to become a member of the Cobrand Partner must directly apply to the Cobrand Partner. Note: there is no fee charged for the Cobrand Partner membership.
  2. In connection with the registration for membership of the Cobrand Partner as described above, the Cobrand Card Holder hereby authorizes BCA to provide the Cobrand Card Holder’s data to the Cobrand Partner.
  3. In the event the prospective cardholder is already a member of the Cobrand partner, if the data provided to BCA do not conform with the data held by the Cobrand Partner, then the prospective Cobrand Partner card holder agrees to create a new membership using the data provided to BCA.
  4. The type of Cobrand Card to be issued for the supplementary Cardholder will be the same as the type of Cobrand Card issued for the main Cardholder.
  5. The Reward BCA from BCA and any loyalty benefits from the Cobrand Partner (if any) will be provided only to the main Cardholder.

Articles 4

  1. BCA will prepay the Merchant or another bank for all transactions made using the Card based on the billing data submitted to BCA.
  2. The Cardholder is responsible to BCA for the billing amounts arising from the transactions.
  3. BCA will provide the Cardholder with a monthly billing statement listing all the transactions made by the Cardholder (“Billing Statement”) in either soft copy (e-Statement) or hard copy, as chosen by the Cardholder. If the Cardholder prefers to receive the Billing Statement in hard copy, BCA may charge the Cardholder the cost of printing the Billing Statement.
  4. The Cardholder must immediately notify BCA of any change of the Cardholder's address and/or telephone number. All consequences arising from a delay in or non-receipt of the Billing Statement due to the Cardholder's failure to notify any changes to the Cardholder's data will be the full responsibility of the Cardholder. The delay or non-receipt of the Billing Statement will not relieve the Cardholder of its obligation to pay the billing amount arising from the use of the Card, including the late charge and interest, in accordance with the applicable provisions at BCA.
  5. The Cardholder must make payment according to the Billing Statement in the minimum amount and on the payment terms as determined by BCA, in rupiah currency (the minimum amount payable is hereinafter called “Minimum Payment”), no later than the due date of the relevant billing month or on the next business day following the due date (if the due date falls on a holiday). Business Day means a day on which BCA and banking institutions in Indonesia are generally open to carry out operational and clearing activities in accordance with Bank Indonesia regulations.
  6. If the amount of Minimum Payment does not reach Rp50,000 (fifty thousand rupiah), the amount payable for the Minimum Payment is Rp50,000 (fifty thousand rupiah).
  7. Late payment of the billing amount may cause transactions to be rejected. BCA reserves the right to block the Card if BCA does not receive payment at least in the amount equal to the Minimum Payment on the due date
  8. In the event of any overdue amounts outstanding, the Cardholder must pay off all such overdue amounts. If the payment is made by cheque/bilyet giro, the payment will be deemed effective when it has been actually received by BCA in good funds. If the cheque/bilyet giro is rejected or canceled, the Carholder will be charged an administration fee and/or other fees (if any), the amount of which will be determined by BCA and notified in any form and by any means in accordance with the applicable law
  9. If the Cardholder's credit quality is classified as ‘loss’ (macet), BCA may use the services of another party for debt collection until all of the Cardholder's obligations to BCA are fully settled.
  10. If, in addition to the Card, the Cardholder also obtains other credit facilities from BCA, the Cardholder’s collectability with respect to the use of the Card and such other credit facilities from BCA will follow the lowest credit collectability assigned according to the data of the Cardholder's credit facilities on record with BCA.
  11. The Cardholder is responsible for all the costs incurred in connection with the issuance and/or use of the Card including but not limited to the annual fee, interest, late charge, card replacement fee, stamp duty, (insurance premium (if the Cardholder agrees to become a credit life insurance customer)), Billing Statement printing charge, as well as other charges and fees (if any), which will be notified by BCA in any form and by any means in accordance with the applicable law

Article 5

If the Card is lost, the Company and/or the Cardholder must immediately report the loss to HALO BCA (24-hour service) or a BCA branch office (during the operating hours of such BCA branch office). If necessary, the Cardholder must provide a written notification of loss signed by the Cardholder in the form and substance satisfactory to BCA. The Cardholder is responsible for all existing card transactions until BCA receives the notification of loss from the Cardholder.

A Card reported as lost in the notice of loss cannot be used to make any transactions. For the purpose of Card replacement, the Cardholder must provide BCA with a clear identity and will be charged a card replacement fee, the amount of which will be notified by BCA in any form and through any means according to the prevailing law. If the lost card is later found, the card must be returned to BCA.

Article 6

BCA will impose a late charge for each monthly balance that remains unpaid after the due date as well as interest at the then applicable rate, calculated from the transaction posting date. BCA has the right to determine the amount of the late charge and interest, which will be notified by BCA to the Cardholder in any form and by any means in accordance with the applicable law.

Article 7

BCA is not responsible for any defects and deficiencies of any nature in the goods or services purchased and paid for using the Card. In the event of a dispute over the purchase of the goods or payment for the services, the Cardholder remains obligated to pay the amount as specified in the Billing Statement.

Article 8

If BCA receives the billing amount from the merchant in a currency other than rupiah, BCA will convert the amount into rupiah based on the exchange rate determined by BCA on the date BCA receives the billing data

Article 9

The Cardholder is fully responsible for the use of the Card including any misuse of the Card, either by the Cardholder or by any other people and the Cardholder may use the Card to conduct transactions that violate the applicable law. All fees and charges incurred in connection with the use of the Card by the Cardholder shall be the full responsibility of the main Cardholder and the supplementary Cardholder, and therefore BCA has the right to directly claim such fees and charges from the main Cardholder and the supplementary Cardholder.

Article 10

BCA has the right to determine the credit limit for the Card, the amount of which will be notified to the Cardholder. The credit limit may be reduced or unconditionally canceled at any time by BCA. The credit limit may also be automatically canceled if the condition of the Company and/or the Cardholder drops to substandard (kurang lancar), doubtful (diragukan), or bad (macet).

BCA under certain considerations has the right to block the Card, terminate the use of the Card, and revoke all rights attached to the Card, among others, if the Cardholder uses the Card to conduct any transactions that violate the applicable law (including provisions on Anti-Money Laundering and Prevention of Terrorism Financing (APU-PPT)), uses the Card for purposes other than as a payment instrument, or if there is an indication that the Company and/or the Cardholder uses the Card to make cash withdrawal/swipe transactions at the Merchant, or if there is an indication that the Cardholder has committed other unlawful acts, or been involved in criminal cases, state administration, tax or civil lawsuits.

BCA has the right to notify the Merchant of the above matters, if necessary. If the use of the Card is terminated, BCA has the right to block the Card and the Company is obliged to pay off all outstanding amounts arising from the use of the Card to BCA immediately in full amount on the Card termination date. The Cardholder and BCA agree to waive the provisions of Article 1266 of the Indonesian Civil Code to the extent that a court decision is required to terminate an agreement, and therefore the Card termination does not need a court decision.

Article 11

The PIN (Personal Identification Number) can be used by the Cardholder to withdraw cash and/or conduct other types of transactions. Such other types of transactions are determined by BCA and will be notified in any form and by any means in accordance with the applicable law. The Cardholder must maintain the confidentiality of the PIN and must not store the PIN and the Card at the same place. The Cardholder is fully responsible for the use of the PIN and any misuse of the PIN, whether by the Cardholder or by other people.

Article 12

As long as the Cardholder still has outstanding obligations to BCA in connection with the use of the main Card, the supplementary Card and/or other obligations, the Main Cardholder and the supplementary Cardholder hereby authorize BCA to block and/or debit any savings account, current account, time deposit account, reward BCA balance, and/or other accounts owned by the main Cardholder and/or the supplementary Cardholder at BCA, and apply the debited amounts to discharge all of the Cardholder’s debts and obligations to BCA, including the principal, interest, penalty, court costs, and other fees and charges.

All consequences arising from the debiting of such accounts and reward BCA balance of the main Cardholder and/or the supplementary Cardholder under such authority shall be the full responsibility of the main Cardholder and the supplementary Cardholder.

Article 13

If the Cardholder is a Merchant, BCA reserves the right to suspend any payments, block and/or debit the Merchant's account or set off any unpaid sum as well as its interest, penalties, and other costs and fees against the Merchant’s claims to BCA.

Article 14

If the Cardholder agrees to become a credit life insurance customer, BCA will charge the Cardholder for the credit life insurance premium. All the risks to be covered by the insurance company are specified in the insurance certificate and the credit life insurance policy. The insurance policy shall set out that BCA is the appointed beneficiary of the sum insured, which will be applied to settle part or all of the Cardholder's debts and obligations to BCA (banker's clause). The Cardholder hereby states that in the event of any insurance claim, the party fully responsible therefor shall be the insurance company. The Cardholder hereby holds BCA harmless against any responsibility for the insurance claim.

Article 15

The Cardholder hereby acknowledges that all records, printouts, recordings, communication media, or any other evidence held by BCA connected with the transactions conducted by the Cardholder constitute valid and conclusive evidence binding on the Cardholder, unless proven otherwise.

Article 16

The powers and authority granted under these Terms and Conditions for BCA Card are irrevocable and will not terminate for any reason, including those specified in articles 1813, 1814, and 1816 of the Indonesian Civil Code as long as the Cardholder still has outstanding obligations to BCA arising from the use of the Card.

Article 17

The Cardholder hereby authorizes BCA to provide the Cobrand Partner with the Cardholder’s data and transaction data on the use of the Cobrand Card in connection with the cooperation in the issuance and marketing of the Cobrand Card.

Article 18

All complaints in connection with the Card may be lodged by the Cardholder through Halo BCA or a BCA branch office. For the purpose of handling such complaint, BCA may require the Cardholder to provide BCA with a copy of the Cardholder's identity card and other supporting documents.

If the Cardholder has a complaint/objection related to any transaction printed in the Billing Statement, the complaint/objection must be lodged by the Cardholder with BCA no later than 30 (thirty) calendar days of the Billing Statement print date. BCA has the right not to deal with any complaint/objection received by BCA after the lapse of such period.

Article 19

Upon the termination of the cooperation between BCA and the Cobrand Partner in the issuance and marketing of the Cobrand Card, the Cardholder hereby authorizes BCA to replace the Cobrand Card and the Cobrand Partner in accordance with the provisions applicable at BCA.

The termination of the cooperation between BCA and the Cobrand Partner in the issuance and/or marketing of the Cobrand Card shall not release the Cardholder from all of the Cardholder’s outstanding obligations arising in connection with the use of the Cobrand Card.

Article 20

The Cardholder hereby agrees to comply with and to be bound by the provisions contained in the Terms and Conditions for BCA Credit Cards, the Card application form, the welcome pack, and the Card usage procedure, as well as the terms and conditions for membership of each Cobrand Partner for the Cobrand Card Holder. BCA has the right to modify the provisions contained in these Terms and Conditions for BCA Credit Cards, including but not limited to the provisions regarding penalties, administration fees, credit limits, and Minimum Payment, the Card application form, the welcome pack, and the Card usage procedure, which will be notified by BCA to the Cardholder in any form and through any means according to the applicable law.

Article 21

  1. The Cardholder agrees that any dispute or difference of opinion arising from and/or in connection with the implementation of these Terms and Conditions for BCA Credit Cards will be resolved in an amicable manner.
  2. Any dispute or difference of opinion that cannot be amicably resolved between BCA and the Cardholder will be resolved through the banking mediation facility at Bank Indonesia or the Financial Services Authority or by means of mediation through an Alternative Dispute Resolution Institution included in the List of Alternative Dispute Resolution Institutions established by the Financial Services Authority.
  3. Any dispute or difference of opinion that cannot be resolved in an amicable manner and/or by means of the mediation as described in item 2 of this Article will be resolved through the District Court of Central Jakarta, without prejudice to BCA's right to file a suit or claim through any other District Court within the territory of the Republic of Indonesia.

These Terms and Conditions for BCA Credit Cards have been adjusted to the prevailing laws and regulations including regulations of the Financial Services Authority.
