VINDI TERMS OF SERVICE PT BANK CENTRAL ASIA Tbk

A. DEFINITIONS

  1. Vindi (Financial Diary)is a banking product and service of PT Bank Central Asia Tbk (“BCA”) that can be accessed directly by customers through Vindi app/application on smart phones (Android/iOS with certain specifications) or the website of KlikBCA to obtain real time transaction information on theaccount usage and financial analysis of the customers.
  2. BCA mobile is an app/application that can be downloaded from the official website of BCA or the official application/software distribution media designated by BCA owned by the mobile operating system on the customers’ smartphones to make transactions via m-BCA and KlikBCA or to obtain BCA Info.
  3. Access Code is a personal code for the customers who use the m-BCA facility on the BCA mobile menu.
  4. KlikBCA IndividuorKBIis a BCA Internet Banking service (KlikBCA) that can be accessed by individual customersthrough smart phones/laptops/personal computers.
  5. User ID is the identity of the users of the BCA Internet Banking facility, which is used to login to “KlikBCA Individu”.
  6. PIN IB (Personal Identification Number Internet Banking) is a personal identification number for the customers who use the Internet Banking facilities of BCA, which is used to log in to KlikBCA Individu.
  7. BCA Credit Card are all types of credit cards issued by BCA at the request of the Customers.
  8. BCA ATM Card is an Automated Teller Machine (ATM) card issued by BCA that can be used by its holders to complete certain banking transactions through the ATMs of BCA and/or other facilities determined by BCA.
  9. Customers are individual account holders in the form of savings, current accounts, and/or BCA Credit Cards of the type determined by BCA and which have met the Vindi user criteria determined by BCA.
  10. Account is a fund account with a certain type and/or a BCA Credit Card account with a certain type belonging to the customers whose transaction information can be accessed through Vindi app.

 B. VINDI REGISTRATION

  1. Every customer who owns BCA mobile and/or KlikBCA Individu can use Vindi.
  2. In order to be able to use Vindi app/application, the customers must:
    1. own and use BCA mobile app/application and/or KlikBCA Individu;
    2. download and install Vindi app;
    3. agree to Vindi Terms of Service;
    4. Login to BCA mobile or KlikBCA Individu by inputing the BCA mobile’s Access Code (login to BCA mobile) or inputing the User ID and IB PIN (login to KBI) which have been determined by the customers when registering for BCA mobile and/or KlikBCA Individu.

C. VINDI TERMS OF SERVICE

  1. The customers must first read and agree to Vindi Terms of Service in order to be able to use Vindi.
  2. As a sign of agreement to Vindi Terms of Service, the customers are required to input Access Code when logging in to BCA mobile or input the ID and IB PIN of the users when logging in through KlikBCA Individu before being able to view information on transactions in the Account thatcustomers have opened.
  3. By using Vindi, the customers allow BCA to send data on transactions made through the Account to a party appointed by BCA for analysis for the purpose of providing information on the financial analysis of said customers. The transaction data that shall be sent are:
    1. The transaction data in the current month up to 3 (three) months prior to the registration date of Vindi;
    2. The data of transaction made by customers since they first use Vindi, including transaction data on the Account opened by the customers in the future.
  4. Through Vindi, the customers are able to, among others:
    1. access all transactions made through the Account;
    2. set spending targets;
    3. set/determine the category of spending/expenditure;
    4. view transaction history on the Account for certain periods;
    5. obtain information on the list of transactions on the Account based on certain categories.
  5. The results of financial analysis produced by Vindi are relative because they are based on the number of Accounts selected by the customers in the Account Settings menu to be displayed on Vindi. Even though the Customers do not choose any of the Accounts to be displayed on Vindi, the Customers agrees that BCA shall still be able to send transaction data made through all of their Accounts, thus, they can be displayed on Vindi if at any time required by the Customers.
  6. By taking into consideration the provisions of C.3, C.4, and C.5 above, the customers agree that the transaction data displayed on Vindi is not the evidence of transactions made through theiraccounts. In the event that there are differences between the transaction data displayed on Vindi and those contained in the customers’ account transactionsmutation provided by BCA to the customers through means other than Vindi,among others the mutation transactions on current account, passbooks, KlikBCA Individu, and BCA mobile, thus, the transaction data contained in the customers’ account transactions are deemed valid.
  7. Every instruction from the Customesr stored in the data center of BCA is correct and binding on the Customers and it constitutes valid evidence of the instructions from the customers, unless they can prove otherwise.
  8. By accessing Vindi, the customers acknowledge that all communications and instructions from them received by BCA will be as valid evidence even if it is not recorded in writing and/or the related records are not signed by the Customers and BCA.

D. AUTO LOGIN

  1. By using  Auto Login feature, the customers only need to login 1 (once) and afterwards, they  do no need tolog in every time they access Vindi.
  2. If the Auto Login feature is active, the Customers can receive real-time notification of transactions they made through their Accounts. However, the customers may choose to disable it anytime.
  3. The customers can choose to activate or deactivate the Auto Login feature on Vindi’s Profile menu.
  4. In connection with the aforementioned Auto Login feature, the customers must always maintain the security of the their cellphones to avoid other people making unauthorized access to Vindi.

E. ACCESS CODE, USER ID, IB PIN AND CUSTOMER OBLIGATIONS

  1. Access Code, User ID, and IB PIN may only be used by the authorized Customers.
  2. The Customers are obliged to keep their Access Code, User ID, and/or IB PIN confidential by means of, among other things:
    1. Not disclosing the Access Code, User ID, and/or IB PIN to other people including family members or other close people of the Customers;
    2. Not storingthe Access Code, User ID, and/or IB PIN on records, mobile phones, objects or any other means that allow the Access Code, User ID, and/or IB PIN to be known by others;
    3. Being careful in using the Access Code, User ID, and/or IB PIN so that they are not visible to others;
    4. Not using theirAccess Code, User ID, and/or IB PIN determined or chosen by other people or easily guessed, such as date of birth or its combination thereof;
    5. Not using the Access Code, User ID, and/or IB PIN to access Vindi via public wifi.

 F. VINDI ACCESSIBILITY

  1. Vindi can be accessed and used more than one different deviceboth with iOS and Android.
  2. Blocking BCA mobile or KlikBCA Individu has an impact on Vindi's accessibility:
    1. If either the BCA mobile or KlikBCA Individual Customer is blocked, Vindi can still be accessed through an unblocked channel because they are two different channels..
    2. If both BCA mobile and KlikBCA Individual Customers are blocked, the Vindi app/application will be inaccessible automatically. This condition does not apply if the customers activate the Auto Login feature.
  3. In the event that the customers close their fund Account connected to the BCA ATM Card, the following terms apply:
    1. If the Customers still have their BCA Credit Card Account and they activate the Auto Login feature, Vindi can still be accessed by the Customers;
    2. If the Customers still have their BCA Credit Card Account, but they do not activate the Auto Login feature, and do not uninstall the Customer's BCA mobile application on their cellphones, then Vindi can still be accessed by the Customers.

 G. FORCE MAJEURE

In the event that BCA is unable to carry out the customers’ instructioninputted through the Vindi app/application or there is a disruption in the provision of services through Vindi, either partially or wholly due to events or matters beyond BCA's control or ability, including but not limited to natural disasters, wars, riots, disturbances in equipment/systems/transmissions, power failures, telecommunication disturbances, and government policies or legal provisions that prohibit BCA from providing the services through Vindi, the customers hereby will not involve BCA from all kinds of claims, demands, lawsuits, and/or other legal actions of any kind related to this matter.

H. TERMINATION OF VINDI SERVICE

Vindi service will end if:

  1. The customers end the use of BCA mobile and KlikBCA Individu; and
  2. The customers do not use Vindi within a certain period of time.

I. DISPUTE RESOLUTION

  1. The customers agree that any dispute or difference of opinions arising out of and/or in connection with the implementation of the terms of service of Vindi of PT Bank Central Asia Tbk between the Customers and BCA, shall be resolved by way of amicable discussions to reach consensus.
  2. Any dispute or difference of opinions that cannot be resolved by way of amicable discussions to reach consensus by the Customers with BCA, shall be resolved through banking facilitation at Bank Indonesia (Central Bank of Indonesia) or the Financial Services Authority or mediation through Alternative Dispute Resolution Institutions listed in the List of Alternative Dispute Resolution Institutions determined by the Financial Services Authority.
  3. Any dispute or difference of opinion that cannot be resolved either through amicable discussions to reach consensus and/or mediation as referred to in point I.2 above, shall be resolved through the Central Jakarta District Court, without prejudice to BCA's right to file a lawsuit or claim through another District Court within the territory of the Republic of Indonesia.

J. MISCELLANEOUS

  1. The customers can contact Halo BCA for any problems related to Vindi transactions and blocking.
  2. By using Vindi, the customers hereby declare that they are subjects to the terms of service of Vindi of PT Bank Central Asia Tbk, the provisions of BCA mobile and KlikBCA Individual, as well as all applicable provisions of BCA thet regulate services, facilities, and transactions, which can be carried out using BCA ATM Cards and BCA Credit Cards to be notified by BCA to the Customers in any form and through any means pursuant to the applicable laws and regulations.
  3. BCA has the right to change the Vindi Terms of Service which will be notified by BCA to the Customers in any form and through any means pursuant to the applicable laws and regulations.
  4. The customers can view Vindi user guide on the BCA website, namely www.bca.co.id/vindi

HAVE BEEN ADJUSTED WITHSTATUTORY PROVISIONS INCLUDING
