A. DEFINITIONS

1. OASE Mobile means an application that can be downloaded by the User to a gadget for the purpose of carrying out the Work.
2. OASE Web means an application that can be accessed through a website for the purpose of carrying out the Work.
3. Work means the work involving the operation and maintenance of a BCA Automated Teller Machine (ATM) and other supporting equipment for the BCA ATM.
4. User means either a BCA employee or a Vendor Operator that is given access to OASE Mobile to carry out the Work.
5. Vendor means a party appointed by BCA to carry out the Work.
6. Vendor Username means an identification in the form of an alphanumeric code for use by the Vendor Operator, obtained when the Vendor Admin registers for it on the OASE Web for the purpose of accessing the OASE Mobile.
7. BCA Usernamemeans an identification of a User who is a BCA employee in the form of a BCAdomain user.
8. Passwordmeans a unique code that together with a Vendor Username or a BCA Username is required to access OASE Mobile.
9. Vendor Operator means a Vendor employee that carries out the Work at the location determined by BCA.
10. BCA Operator means a BCA employee that is instructed by a BCA Supervisor to carry out the Work at the location determined by BCA.
11. Vendor Admin means an employee that is authorized by the Vendor to administer the Vendor Username of the Vendor Operator, appoint the Vendor Operator that will carry out the Work at the location determined by BCA, and supervise the Work carried out by the Vendor Operator.
12. BCA Supervisor means a BCA employee responsible for giving an instruction to a BCA Operator and a Vendor Operator to carry out the Work as well as giving approval for the instruction and the Work report made by the BCA Operator through OASE Web.

 

B. OASE MOBILE REGISTRATION

 

C. TERMS OF USE FOR OASE MOBILE 

1. The User can use OASE Mobile for the following purposes:
   1. receiving the Work instruction from the Vendor Admin or BCA Supervisor;
   2. making a report on the implementation result of the Work;
   3. making an inquiry into the Work that has been completed by the User.
2. The User must ensure that the cellular phone used to access OASE Mobile is free from viruses, malware, and/or other things that can harm the User.
3. The User shall be fully responsible for the use of OASE Mobile, including, among other things, the following:
   1. the email address provided when registering for OASE Mobile as a User;
   2. all activities carried out by the BCA Operator/Vendor Operator on OASE Mobile;
   3. any misuse in connection with the administration of the VendorUsernameorBCA Username and/or Password on OASE Mobile.
4. The Work Report made by the User on OASE Mobileshall be deemed as a valid report based on the use of the Vendor Usernameand/or Password. BCA has no obligation to examine or investigate the authenticity or legality of the use of the Vendor Username and/or Password or the authority of the party using the Vendor Usernameand/or Password. The Work Report made by the User on OASE Mobileis legally binding upon the Vendor.
5. The User must maintain the confidentiality of the VendorUsernameorBCAUsernameand/or Password. The Vendor shall be fully responsible for all consequences arising in connection with any misuse of the VendorUsernameand/or Password. 
6. The User cannot log into OASE Mobile using 1 (one) Vendor Usernameor 1 (one) BCA Username on 2 (two) different gadgets at the same time.
7. All consequences arising in connection with the use of OASE Mobile by the User using the Vendor Username and/or Password shall be the sole responsibility of the Vendor.
8. The User, upon BCA's request, must upgrade the hardware and software versions as may be necessary to access OASE Mobile.
9. The User's failure to upgrade the hardware or software as may be necessary to access OASE Mobile may lead to the User’s inability to use OASE Mobile or limited access to certain features on OASE Mobile.
10. The Vendor agrees that BCA has the right to store and use the Vendor’s personal data attached to the cellular phone used by the Vendorto download OASEMobile,among other things, for the Vendor’s convenience and security in accessing OASE Mobile.

 

D. FORCE MAJEURE

The Vendor hereby holds BCA harmless against all lawsuits, demands and/or other legal actions of any kind for any delay and/or failure by BCA to fulfill its obligations related to OASE Mobile if such delay and/or failure is caused by events or things beyond BCA's control or ability to overcome, including but not limited to natural disasters, fires, wars, disease outbreaks, riots, sabotage, equipment/system/transmission breakdown, power failures, system breakdown, telecommunication issues, or any government policy prohibiting BCA from providing the service to the Vendor.

 

E. TERMINATION OF OASE MOBILE

BCA has the right to cease providing the OASE Mobile service to the Vendor, among other things, if:

 

F. BLOCKAGE OF VENDOR USERNAME OR BCA USERNAME 

1. The Vendor Username will be blocked if the User enters the wrong Password 3 (three) times in a row.
2. In the event the Vendor Username is blocked, the User can request a Password reset to the Vendor Admin.
3. Under certain considerations, BCA has the right to block the Vendor Username or BCA Username.

 

G. PROVISIONS FOR COMPLAINTS HANDLING 

1. The User can lodge a complaint with BCA in connection with OASE Mobile through BCA’s person in charge, and the complaint will be notified by BCA to the User in any form and through any means.
2. BCA will respond to the complaint in accordance with the applicable law.

 

H. DISPUTE RESOLUTION

1. The User agrees that any dispute or difference of opinion arising from and/or in connection with the implementation of these Terms of Use for OASE Mobile of BCA (the “Terms”) between the Vendor and BCA will be resolved in an amicable manner.
2. If such amicable resolution of the dispute or difference of opinion has been attempted by the Vendor and BCA but no consensus can be reached, the dispute or difference of opinion will be resolved through banking mediation at Bank Indonesia or the Financial Services Authority or by means of mediation through an Alternative Dispute Resolution Institution included in the List of Alternative Dispute Resolution Institutions established by the Financial Services Authority.
3. If an attempt has been made to resolve the dispute or difference of opinion in an amicable manner, by means of banking mediation, and/or by means of the mediation as referred to in item H.2 above but no consensus can be reached, the dispute or difference of opinion will be resolved through the District Court of Central Jakarta, without prejudice to BCA's right to file a suit or claim through any other District Court within the territory of the Republic of Indonesia.

 

I. MISCELLANEOUS

1. BCA has the right to modify, supplement or replace these Terms, and such modification, supplementation, or replacement will be notified by BCA to the Vendor in any form and through any means in accordance with the applicable law.
2. The Vendor must immediately notify BCA in writing of any change in the Vendor's data.
3. By using OASE Mobile, the User hereby agrees to comply with these Terms and all the provisions applicable at BCA in connection with the Vendor.
4. These Terms form an integral and inseparable part of any agreement connected with the Work signed by the Vendor and BCA.

These Terms of Use for OASE Mobile of PT Bank Central Asia Tbk have been adjusted to the prevailing laws and regulations, including regulations of the Financial Services Authority.
